Kansas City, Kan. (KWCH) – A 39-year-old Salina South Middle School teacher is accused of sitting on and hurting a student during a weightlifting class. On Tuesday, the school board met for the first time since cops said they would not be filing criminal charges against the teacher.
After what happened, the 13-year-old student and his mother are coming out. The teen is said to have passed out, rolled off the bench, and hit his head.
Angelica Garay told what happened on September 6: she got a call telling her that her son Oscar had been hurt at school.
Angie told her that her son had passed out during weightlifting class and hit his head. “He had a cut on his head and was bleeding,” she said. “After that, I went right away to get him.”
Oscar finished what began as a normal seventh-hour weights class with a mild concussion and the need for stitches.
“Then I remember waking up on the floor, all bloody,” he said about the time after he passed out.
The story about what happened was confirmed by the Salina Police Department. However, the Saline County attorney said there wasn’t enough proof to say there was a crime.
“I didn’t believe it; why would you sit on a child?” Angelica spoke up.
The Garay family said it should have never happened.
“If it’s against the rules for students to touch other people, why should teachers be able to?” Angelica spoke up.
The prosecutor for Saline County said Oscar’s case was “playful in nature,” so he did not press charges against the teacher. By telling their story, the Garays hope that something similar will never happen again.
